Schatzi gets everything

Inheritance law

Schatzi gets everything

A pub landlord from East Frisia wanted to make his will. He took his small notepad on which he wrote his customers' orders, tore out a sheet and wrote on it “My will: Schatzi gets everything”, signed it and put it in the drawer.

After his death, Schatzi took it out of the drawer and asked for a certificate of inheritance. As Schatzi was easily identifiable as a person, the will was written very briefly but signed in full by hand, she was recognised as the sole heir (Oldenburg Higher Regional Court, decision of 20.12.2023, ref. 3 W 96/23).

The formal requirements for a handwritten will are roughly the same in Germany and Italy, but as Italians are generally more fond of form than Germans, it is at least questionable whether an Italian court would have ruled the same way.
